Are employers personally liable for unpaid EPF contributions in Malaysia?

Yes — company directors can be held personally liable for unpaid EPF contributions, and that liability doesn't depend on which payroll provider is used. OCTIS runs EPF, SOCSO and PCB calculations as part of every payroll cycle to keep contributions correct and on time.

Do I need to register a local entity to hire an employee in Malaysia?

No — an Employer of Record lets a company employ someone in Malaysia without registering its own local entity, with the EOR acting as the legal employer on record while EPF, SOCSO and EIS contributions and Employment Act 1955 compliance are handled at the rate fixed by law. OCTIS's EOR service puts people on the ground in Malaysia this way, backed by payroll, tax, legal and company-secretarial support.

Is the HRD Corp training levy compulsory for every Malaysian company?

No — the HRD Corp levy becomes compulsory once a company passes ten Malaysian employees, it's borne by the employer rather than the employee, and the obligation doesn't shift depending on which training provider delivers the course. OCTIS's training programmes are HRD Corp claimable, so an eligible company can recover the cost through its own levy.

Do recruitment agencies charge a fee even if they don't successfully place a candidate?

It depends on the engagement model — a retained search is paid for the search itself whether or not it ends in a hire, while a contingency or success-fee search charges nothing without a placement. OCTIS's recruitment service is success-fee based, so the fee is triggered by the placement itself.

What's included in an Employer of Record service besides running payroll?

An Employer of Record service typically also covers the employment contract and its legal compliance, and the statutory filings that come with being an employer, plus company-secretarial compliance for the employer entity itself. OCTIS adds full HR and legal advisory on top, through people who know the account rather than a generic helpdesk.
